Waiver

Please read this waiver carefully. If you do not understand anything in this waiver, please contact us for clarification. No enrolments will be accepted without express acceptance of this waiver. 

I understand that any moneys paid in advance by me for the purpose of receiving instruction, once paid are not refundable. I consent that any pictures furnished by me or any purpose taken of me in connection with the International Karate Organization Kyokushinkaikan / North Bondi Kyokushin Pty Ltd (hereafter, “NBK”) can be used for publicity, promotion or television showing, and waive compensation in regard thereto. I understand that NBK reserves the right to terminate or suspend my membership, without recompense, for reasons of unacceptable behaviour or unreasonable length of absence to be determined by said corporation at its sole discretion. I solemnly swear that I am a law-abiding citizen and that at no time shall I ever use the techniques of karate or self-defense in a manner that will inflict personal injury or bodily harm to anyone, except in cases of emergency needs whereby my life and safety, or the lives and physical safety of others may depend upon my knowledge and application of these techniques. I will not be under the influence of drugs or alcohol at the time of any training session or other participation in karate.
*Furthermore, for myself, my spouse, legal representatives, heirs and assigns, hereby release, waive and forever discharge NBK, its officers, staff, interns and fellow members (collectively, the "Releasees") from any and all claim, demand, action or right of action, of whatever kind of nature, either in law or in equity, for damages for death, personal injury or property damage which I may have, or which may subsequently accrue to me, arising out of or connected in any way with my participation in the karate program at NBK, whether caused by the negligence of NBK or otherwise. I further release the Releasees from any claim whatsoever on account of first aid, treatment or services rendered to me during my participation in the karate program at NBK. I further understand that serious accidents occasionally occur in the sport of karate, and that persons engaging in karate occasionally sustain mortal or serious personal injuries and/or property damage as a consequence thereof. Knowing the risks of karate, nevertheless, I hereby agree to assume those risks and to release and hold harmless the Releasees who, through negligence or otherwise, might be liable to me, my spouse, legal representatives, heirs and assigns for damages. I expressly agree that the provisions of this release, waiver and indemnity are contractual (and not a mere recital) and are intended to be as broad and inclusive as permitted by the laws of the State NSW, Australia, and that if any portion thereof is held invalid, it is agreed that the remaining provisions shall, notwithstanding, continue in full legal force and effect.

This waiver, release and assumption of risk is to be binding on my heirs and assigns.

A REGISTRATION FEE is paid to become a member of the IKO Kyokushinkaikan. Registration is a ONE TIME fee and you will be provided an IKO Lifetime Membership Card. Registration Fees are NON-REFUNDABLE and do not include tuition.

EQUIPMENT purchased is NOT RETURNABLE/REFUNDABLE.

TUITION is paid to take classes and to use the facilities at Kyokushin Karate North Bondi. Tuition is paid in addition to Registration at the time of enrolment. Tuition may start at anytime, but payments must be made in advance. If you are starting any time after the beginning of a term/month/quarter/year, pro rata payments may be requested of you in cash or by cheque, or additional days may pro-rated forward to the next billing cycle.

Once enrolled as a member and tuition plan selected, your membership will automatically renew at the end of your enrolment term. In other words, you must notify us if you cannot continue*, otherwise as a member, you are responsible for tuition payments regardless of your attendance.

Tuition can only be paid for through our PaySmart automated system. No other regular payments can be accommodated. Regular payments must be up to date in order to take classes and use the facilities – LATE FEES will be applied to delinquent accounts. Tuition is NON REFUNDABLE, except in the case of our “Satisfaction Guarantee”, whereby a student may discontinue their membership WITHIN their trial period.
*If you cannot continue, you may suspend your tuition & membership, or make a formal withdrawal. (See "Membership Suspension/ Freeze Policy")

* MEMBERSHIP SUSPENSION COURTESY / FREEZE POLICY * The Suspension /or ‘FREEZE’ courtesy, refers to the temporary halting of a student's current Membership status and Tuition for whatever reason, so that their membership status and any remaining tuition will not be forfeited. Freeze requests must be made IN WRITING to info@karatebondi.com and must be made at least 10 days IN ADVANCE of your next debit order. Freezes are NOT RETROACTIVE.
*A nominal Freeze Fee may be charged on your following account debit.
*A student may Freeze their membership once per enrolment period at any time for a minimum period of 1 month to a maximum period of 3 months at a time.
*Medical (or Maternity) Leave is permitted for up to 12 months or more provided you have notified us. 
Medical Leaves incur NO fees.

*We accept cheques.
*Do not send CASH by post.
*Provide us with a PASSPORT PHOTO the IKO Membership Card with your full name and date of birth written in ink on the back, as well as the required fee.
